11 December 2008. Terrace Forum - Can Western Australia achieve 20% renewable energy by 2020?
Dr Ray Wills, CEO of the WA Sustainable Energy Association, and Ken Brown, Western Power’s Manager, System Development to address the forum.
Ken Brown will outline some of the practical considerations that need to be addressed in accommodating the 20% target. Ray Willis will put the case for how the 20% target can be achieved.
We are hoping that they will provoke a lively discussion on whether the target is achievable or a pipe dream.
The meeting will be held in the Boardroom of Jackson McDonald, 25th floor, 140 St George's Terrace, on Thursday, December 11, 2008. Please arrive at 12.30pm for a 12.45 start. The formal meeting will conclude promptly at 2pm, although guests are welcome to continue the discussion longer if they wish.

Jackson McDonald host the launch of SoCLA
On the 5th of June 2009, Jackson McDonald will host the launch of the Society of Construction Law Australia. A cocktail function will be held and the Hon. Justice Newnes (JA) will officiate the Western Australian launch.
SoCLA is a National body with a founding Council of sixteen members and membership which will be drawn from the construction professions, industry representatives and the legal profession.
The inspiration for the Australian Society is the exceptional contribution to the subject made by the SCL founded in the UK in 1983. Similar societies include the European SCL, SCL, Hong Kong, Singapore and UAE. The object of the Australian Society stated in the Constitution is:
“… to promote the education, study and research (and publication of the useful results of such research) in the field of construction law and related subjects both in Australia and overseas for the benefit of the public and the construction industry. “

Jackson McDonald Cup Final 2009
The Jackson McDonald High School Cup Final will be held on the 17th of May 2009.
The course of the competition began early March, where six teams of high school students were required to attend two 'mooting' workshops run by Murdoch University. While closley mentored by a member of the Murdoch Mooting Bench, the students were required to submit two sets of written submissions and compete in a series of oral rounds. The finals for the Jackson McDonal Cup will be held at the Federal Court of Australia with the Grand Final Moot starting at 7pm.

- All Saints
- Georgina Molloy

Asset owners see access as jeopardising their own operations and risking damage or disruption to their valuable infrastructure.
Access seekers believe that access is essential to developing Australia’s competitive economy.
Regulators have the battle of striking a workable balance between the opposing interests.
Everyone decries the cost and complexity of the process. So, is Third Party infrastructure access truly workable or is it just a political pipedream?

The workshop will start with a review of the legal issues most likely to confront Directors and Senior Management operating in a turbulent market. 11 August 2009. Terrace Forum: Energy from MARS – what can we learn?
Mike Laughton-Smith, General Manager of Island System Development at Horizon Power will be discussing the topic of Modular Automated Renewable Scalable (MARS). These are off-grid projects to deliver power to remote aboriginal communities, which combine a high level of renewables with traditional power generation. Mike will discuss the technical challenges of these projects, but will also look at the importance of community engagement and how this impacts on a project. It will be interesting to explore whether there are parallels that can be drawn, or lessons learnt, for larger projects on the grid.

9 February 2010. Directors Briefing: Andrew Forrest - The Inside Story
The recent decision of ASIC v Fortescue Metals Group Ltd and Forrest has seen the Court for the first time deal with the question of an individual’s potential liability for non-disclosure or misleading and deceptive disclosure to the market.
Justice Gilmour’s findings, (which relate to continuous disclosure obligations) provides company directors with guidance as to what is expected regarding the content and accuracy of ASX and media releases.
James Scovell of Jackson McDonald, who acted for Andrew Forrest, will provide an insight into the case and what it means for company directors and executives.

26 May 2010. Directors Briefing: Indigenous Governance
Jackson McDonald are proud to host the Australian Institute of Company Directors (AICD) briefing on indigenous governance.
With the increasing focus on governance at all levels of business, a number of indigenous organisations in Western Australia are looking to appoint independent Directors who can contribute to and participate in the growth and development of their organisations and their integration into mainstream Australia.
Independent Directors on indigenous boards face unique challenges and steep learning curves. A panel of experienced Directors who have served on Advisory and Trustee Boards will discuss the skills, competencies and experiences expected of Directors on indigenous boards, addressing some of the cultural and fiduciary relationships that are unique to Directors and Boards in this sector.

15 June 2010. STEP Speaker Presentation: Beneficiary's rights on breaches by trustees and executors
Jackson McDonald in conjunction with Perpetual and NAB are proud to present a Society of Trust & Estate Planning (STEP) seminar presentation by Jeremy Curthoys from John Toohey Chambers.
Jeremy will speak to the paper by the Honourable Justice Tom Gray of the Supreme Court of South Australia which was delivered at the launch of Adelaide branch of STEP on 12 February 2010 on the topic “Beneficiary’s rights on breaches by trustees and executors”.
The paper outlines a number of rights and remedies available to beneficiaries on breaches by trustees and executors. The following matters, among others, will be briefly examined:
- the nature of the beneficiaries’ rights
- the office of trustee and executor
- remedies for breach of trust
- compelling the performance of the trust
- restraining breach of a trust
- other options available to beneficiaries
Jeremy has also agreed to provide a short addendum to the paper highlighting the relevant West Australian specific provisions.
