Occupational Safety & Health

Our Occupational Safety & Health team, comprised of experienced practitioners from various practice groups within the firm, assists employers to ensure compliance with their obligations under OSH legislation.

By obtaining knowledge and understanding of our clients’ policies and procedures, we are able to advise any of their employees as to the steps to take in the event of an incident.

Our practitioners also have extensive experience in representing employers and employees in prosecutions against them for breaches of the Occupational Safety and Health Act 1984 (WA) and the Mines Safety and Inspection Act 1994 (WA).

We can provide advice on and representation for:

  • adequacy of any policies or procedures relating to OSH in the workplace
  • OSH training on site (including remote mine sites) for employees
  • employer's rights and obligations in response to an incident
  • incident investigations
  • investigations by regulatory authorities including WorkSafe, Resources Safety, Electrical Safety, the Police and the Coroner
  • liaising with the prosecuting authority to determine the particulars of the charge
  • gathering evidence and drafting court documentation including affidavits

We offer our clients emergency assistance in the event of an OSH incident, including after hours and on weekends.
