The Jackson McDonald partnership has grown to 31 following the announcement of four new partners. Three out of the four new partners have been promoted from senior associates and the fourth, Simon Moen joins the property practice group from another firm.

We have also promoted across all levels, with one new special counsel, two senior associates and nine new associates. The growth is representative of the firm’s strong position in the West Australian legal market.

Foreign Investment in Australian Residential Real Estate

In Australia foreign investment is regulated principally by the Foreign Acquisitions and Takeovers Act 1975 together with a range of Regulations and Foreign Investment Policy Guidelines which are issued by the Australian Government. The Federal Treasurer, assisted by the Foreign Investment Review Board, administers the Act, the Regulations and the Policy Guidelines.

The Assistant Treasurer recently announced changes to Australia’s foreign investment rules as these relate to residential real estate acquisitions and introduced “tough new civil penalty, compliance, monitoring and enforcement measures”.

The Foreign Investment and Trade Policy Division of the Commonwealth Treasury recently released a summary of the rules relating to foreign investment in residential real estate. A link to the summary is contained below, for your information.

This summary only applies to the rules relating to foreign investment in residential real estate. The Act, the Regulations and the Policy Guidelines apply to a wide range of foreign investments in Australian assets.
